Driver Licence Lookup Terms of Use

These Terms of Use govern your access to and use of Driver Licence Lookup, including the website, dashboard, upload tools, lookup tools, status reports, search history, account features, subscription plans, credits, and related services.

By creating an account, accessing the platform, uploading information, purchasing credits, submitting a licence check, clicking "I Agree," typing your name, applying an electronic signature, or otherwise using Driver Licence Lookup, you agree to be bound by these Terms of Use.

If you do not agree, you must not access or use the platform.

1. Definitions

"Driver Licence Lookup," "we," "us," or "our" means the owner/operator of the Driver Licence Lookup platform.

"Platform" means the Driver Licence Lookup website, dashboard, upload tools, licence-check tools, search tools, records, status reports, account pages, and related software features.

"User," "you," or "your" means the person or entity creating an account, accessing the platform, uploading information, submitting licence checks, purchasing credits, or using the service.

"Licence Check" (or "lookup") means a search, attempted search, automated check, batch check, or retrieval attempt submitted through the platform against the Ontario Ministry of Transportation (MTO) driver's licence records.

"Credits" means prepaid or subscription-based licence-check units used to submit or process checks.

"Submitted Information" means information entered, uploaded, imported, or submitted by a user, including 15-character Ontario driver's licence numbers, driver names or identifiers, internal fleet/contractor reference numbers, contact information, or other information.

"Results" means information retrieved, displayed, stored, or generated through the platform, including licence status (such as Valid, Suspended, Expired, Cancelled), MTO order references, timestamps, and not-found results.

2. Nature of the Service

Driver Licence Lookup is a software-as-a-service tool designed to assist fleets, contractor managers, insurance carriers, and similar users with organizing and checking the public-record status of Ontario driver's licences based on user-submitted licence numbers.

Driver Licence Lookup is not a government agency, the Ontario Ministry of Transportation, a court, a tribunal, an insurance carrier, an investigator, or a legal advice provider.

The platform does not provide legal advice, legal opinions, legal representation, fitness-to-drive opinions, insurance coverage determinations, employment decisions, or professional judgment about any driver, licence, suspension, conviction, or proceeding.

3. No Affiliation With Government

Driver Licence Lookup is not affiliated with, endorsed by, operated by, or authorized by the Government of Ontario, the Ministry of Transportation, ServiceOntario, any court, any municipality, any police service, or any government payment or lookup portal.

The platform relies on information returned from the public MTO Driver's Licence Check service and may rely on third-party providers (for example anti-CAPTCHA services) to interact with it. We do not control those systems.

4. User Responsibility to Verify Information

You remain solely responsible for reviewing, confirming, and independently verifying all information before relying on it.

This includes, but is not limited to: licence status; suspension or reinstatement dates; expiry dates; cancellation information; demerit, conviction, or enforcement information; identity matching between the licence number and the driver; insurance coverage; and not-found results.

You must not rely on Driver Licence Lookup as the sole source of truth for urgent, deadline-sensitive, coverage-sensitive, hiring, dispatch, or termination decisions. Confirm directly with the MTO and the driver before acting.

5. No Guarantee of Accuracy, Completeness, or Availability

Driver Licence Lookup does not guarantee that any check, result, status, MTO record, or report will be accurate, complete, current, available, uninterrupted, or suitable for any particular purpose.

Results may be affected by: incorrect or incomplete user-entered licence numbers; outdated MTO records; formatting errors; changes to the MTO service; downtime; CAPTCHA or anti-bot restrictions; delayed MTO updates; missing records; duplicate records; data errors at the source; system errors; network interruptions; third-party website changes; or search limitations.

You accept these risks when using the platform.

6. User-Submitted Information

You are solely responsible for the accuracy, legality, and authorization of all information you enter, upload, import, or submit to the platform.

You represent and warrant that: you have authority to submit the licence numbers and related information; you have any required driver consent, employment authorization, or contractor authorization required to check the driver's licence status; you are not submitting information for an improper, unauthorized, harassing, or discriminatory purpose; the information is accurate to the best of your knowledge; and your use of the platform complies with all applicable laws, including privacy laws, employment laws, and any insurance, contractor, or fleet-management regulations.

7. Compliance and Regulatory Obligations

If you are a fleet manager, compliance lead, safety officer, insurance underwriter, broker, contractor manager, HR representative, dispatcher, or service provider, you remain solely responsible for complying with all applicable laws, regulatory obligations, professional obligations, confidentiality obligations, employment law, privacy law, and contractual obligations applicable to you.

Driver Licence Lookup does not supervise your operation, manage your drivers, confirm your hiring or dispatch decisions, advise on insurance coverage, or replace your professional judgment.

You are responsible for determining whether your use of the platform is appropriate for your operation, drivers, contractors, and obligations.

8. Account Registration and Profile Information

You agree to provide accurate, current, and complete account and profile information, including your name, contact information, company name, and role/title where applicable.

You agree to promptly update your information if it changes.

We may suspend or terminate your account if we believe your profile information is inaccurate, incomplete, misleading, unauthorized, or associated with misuse of the platform.

9. Account Security

You are responsible for maintaining the confidentiality of your login credentials.

You must not share your account with unauthorized users, allow another person to use your credentials, sell or transfer access, bypass account or credit limits, access another user's account, or use the platform for unauthorized third-party searches.

You are responsible for all activity under your account.

10. Credits, Subscriptions, and Lookup Usage

Credits are used to submit or process licence checks. One credit is consumed per driver's licence checked.

As an automatic courtesy: any credit charged for a check that returns no matching record from the MTO service will be restored to your account when Driver Licence Lookup detects the not-found result. Reconciliation occurs the next time you view your dashboard or initiate another check.

Credits are not refunded for: checks that successfully return an MTO record (even if the user later disputes the data); subscription billing periods, which are non-refundable per Section 11; or successful checks submitted with incorrect, incomplete, or outdated user-supplied information where a record was nonetheless returned.

Unused monthly subscription credits expire at the end of the applicable billing period unless rollover is expressly included in your plan. We may also, at our discretion, restore credits for checks that fail because of a platform-side technical error.

We may change pricing, plans, credit packages, or subscription terms on notice to users.

11. No Refunds Except Where Required

All purchases, subscriptions, and credit packages are final and non-refundable except where required by law or expressly approved by Driver Licence Lookup in writing.

We may, at our discretion, issue a credit, account adjustment, or goodwill refund. Doing so does not create an obligation to do so again.

12. Uploads, Validation, and Import Errors

The platform may provide upload validation tools to identify missing or improperly formatted licence numbers.

Validation tools are provided for convenience only. They do not guarantee that submitted information is correct, complete, searchable, or sufficient to return a result.

You remain responsible for checking all uploaded data before submitting checks.

13. Records and Reports

The platform may capture or store licence-check results, MTO order references, timestamps, or search history.

Stored results are provided for convenience and audit purposes only. They may not reflect later changes to the MTO record.

You remain responsible for confirming whether information has changed after a check is completed.

14. Acceptable Use

You agree not to use the platform to: violate any law or regulation; violate privacy or employment law; conduct unauthorized searches; harass, monitor, or investigate individuals for improper purposes; upload information you are not authorized to use; reverse engineer the platform; scrape, copy, resell, or reproduce platform data; bypass rate limits, credit limits, authentication, or security features; interfere with platform operation; use automated scripts outside approved platform features; introduce malware or harmful code; or misrepresent the platform as an official government or MTO system.

15. Service Availability

We may modify, suspend, interrupt, restrict, or discontinue the platform at any time, including for maintenance, updates, security, third-party changes, technical issues, or business reasons. We do not guarantee uninterrupted access.

16. Third-Party Systems

The platform depends on third-party systems, including the public MTO Driver's Licence Check service, hosting providers, payment processors, anti-CAPTCHA providers, email providers, analytics tools, and security tools.

We are not responsible for third-party outages, restrictions, errors, data changes, downtime, access blocks, CAPTCHA changes, policy changes, or unavailability.

17. Privacy and Data Protection

Your use of the platform is also governed by our Privacy Policy. By using the platform, you consent to the collection, use, storage, and disclosure of information as described in the Privacy Policy.

We aim to minimize the information required to perform checks. However, you are responsible for ensuring that any information submitted to the platform is authorized and appropriate, including any driver consent or authorization required under applicable law.

18. Confidentiality

We will take reasonable steps to protect user account information and submitted information. However, no internet-based platform can guarantee absolute security.

You acknowledge that you are responsible for deciding whether the platform is appropriate for your confidentiality obligations and driver-related information.

19. Intellectual Property

Driver Licence Lookup, including its website, software, workflows, user interface, design, text, graphics, branding, code, features, and documentation, is owned by or licensed to Driver Licence Lookup.

You receive a limited, revocable, non-exclusive, non-transferable licence to use the platform for your internal business purposes in accordance with these Terms. You do not acquire ownership of the platform or its intellectual property.

20. Beta Features

We may offer beta, test, experimental, or preview features. Beta features may be incomplete, unstable, inaccurate, or discontinued at any time. You use beta features at your own risk.

21. Suspension and Termination

We may suspend or terminate your account if we believe that you breached these Terms, provided false or misleading profile information, misused the platform, created legal/security/operational/reputational risk, failed payment, attempted to bypass platform restrictions, or used the platform for unauthorized purposes.

Upon termination, your access to the platform may be disabled.

22. Disclaimers

The platform is provided on an "as is" and "as available" basis.

To the maximum extent permitted by law, we disclaim all warranties, representations, and conditions, whether express, implied, statutory, or otherwise, including warranties of accuracy, availability, merchantability, fitness for a particular purpose, non-infringement, reliability, and uninterrupted service.

23. Limitation of Liability

To the maximum extent permitted by law, Driver Licence Lookup's total liability for any claim arising out of or relating to the platform, these Terms, any check, any result, any subscription, or any user's reliance on the platform shall not exceed the amount paid by the user to Driver Licence Lookup in the three months immediately preceding the event giving rise to the claim.

24. Exclusion of Damages

To the maximum extent permitted by law, Driver Licence Lookup shall not be liable for: denied insurance claims; lost contracts; missed compliance deadlines; hiring, firing, or dispatch decisions; coverage disputes; lost profits; lost revenue; loss of business; reputational harm; loss of goodwill; loss of data; indirect, consequential, incidental, special, punitive, or reliance damages; damages arising from third-party systems; damages arising from user-entered information; or damages arising from unavailable or inaccurate MTO data.

25. Indemnity

You agree to indemnify and hold harmless Driver Licence Lookup, its owners, directors, officers, employees, contractors, service providers, and affiliates from any claims, demands, losses, damages, costs, expenses, legal fees, complaints, regulatory issues, or proceedings arising from: your use of the platform; your submitted information; your breach of these Terms; your breach of privacy, employment, or contractual obligations; unauthorized searches; reliance on check results; failure to verify information; misuse of credits or account access; or any claim brought by a driver, contractor, employee, client, insurer, or third party.

26. Electronic Acceptance and Signature

You agree that your electronic acceptance of these Terms, including clicking "I Agree," typing your name, applying an electronic signature, checking acknowledgment boxes, or using the platform, is intended to be your electronic signature and has the same effect as signing a written agreement.

You consent to receive and accept these Terms, the Privacy Policy, notices, records, and account communications electronically.

We may store records of your acceptance, including timestamp, IP address, user agent, account details, signature, Terms version, Privacy Policy version, and related audit information.

27. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we may require you to accept the updated Terms before continuing to use the platform.

Your continued use of the platform after updated Terms become effective means you accept the updated Terms.

28. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.

The courts of Ontario shall have jurisdiction over disputes arising from or relating to these Terms or the platform, unless applicable law requires otherwise.

29. Entire Agreement

These Terms, together with the Privacy Policy and any applicable subscription or pricing terms, form the entire agreement between you and Driver Licence Lookup regarding your use of the platform.
